Using FormDino

Terms of Service

The practical rules for FormDino accounts, forms, subscriptions, customer content, and an evolving product.

Agreement and eligibility

These Terms of Service (“Terms”) are an agreement between you and Ann Arbor Apps LLC, doing business as FormDino (“FormDino,” “we,” “us,” or “our”). They govern your access to and use of FormDino websites, applications, forms, embeds, APIs, and related services (the “Service”).

By creating an account, starting a trial, purchasing a plan, or using the Service, you agree to these Terms. You must be at least 18 years old and able to enter a binding contract. If you use the Service for an organization, you represent that you can bind that organization.

Accounts and access

You must provide accurate information, keep account credentials and connected sign-in methods secure, and promptly update relevant account information. You are responsible for activity under your account and for the people you authorize to use it.

Tell us promptly if you believe an account has been accessed without authorization. We may require reasonable verification before changing account ownership, access, or billing information.

The Service will evolve

FormDino is a new and evolving product. We may add, change, redesign, replace, or discontinue features, integrations, limits, or supporting technology. We may offer previews, experiments, or beta features with additional terms or reduced support.

We will use reasonable efforts to give advance notice when a material change is likely to substantially reduce paid functionality during a current subscription term. Enterprise commitments apply only when stated in a separate written agreement.

Your content and submissions

You retain ownership of the forms, questions, branding, submissions, and other content you provide to the Service (“Customer Content”). You grant FormDino a worldwide, non-exclusive license to host, copy, process, transmit, display, and modify Customer Content only as reasonably needed to provide, maintain, secure, improve, and support the Service or comply with law.

You are responsible for Customer Content, the purpose and wording of your forms, who receives access, and the notices, permissions, and legal basis needed to collect and use submissions. You must honor applicable requests from form submitters and must not ask for information that you are not authorized to collect.

Acceptable use

You may not use the Service to:

  • Break the law, violate rights, deceive people, or facilitate harm.
  • Distribute malicious code or interfere with the Service or another user.
  • Probe, bypass, or defeat access controls, plan limits, or usage safeguards.
  • Impersonate others or misrepresent a form’s source, purpose, or affiliation.
  • Collect highly sensitive or regulated data unless a FormDino feature or separate written agreement expressly supports that use.
  • Resell, copy, reverse engineer, or exploit the Service except as permitted by law or a written agreement.
  • Use the Service in a way that creates unreasonable load or risk for FormDino, its providers, or other customers.

We may investigate suspected violations and remove content, restrict functionality, or suspend access when reasonably necessary.

Trials, plans, and billing

FormDino offers paid plans and may offer add-ons, custom capacity, or Enterprise arrangements. Current public prices, included limits, and billing intervals are shown on the pricing page or at checkout.

Public plans currently include a 14-day trial and require a payment method at signup. Unless you cancel before the trial ends, the selected plan begins automatically and the payment method is charged. Paid subscriptions renew automatically for the selected monthly or annual interval until canceled.

You authorize FormDino and its payment processor to charge subscription, add-on, usage, tax, and other amounts disclosed at purchase. Except where required by law or stated at purchase, charges are non-refundable. Cancellation stops future renewals and normally takes effect at the end of the current paid term. Plan changes, credits, or prorated amounts will be shown when applicable.

We may change future pricing or plan structures with advance notice. Changes generally apply at the next renewal unless you agree to an earlier change.

Visitor payments and connected Stripe accounts

A FormDino customer may connect its own Standard Stripe account and require a fixed, one-time payment on an Egg. Each visitor payment is a direct charge on that connected Stripe account. The form owner—not FormDino—is the seller and merchant of record, receives the funds, and has the direct payment relationship with the form visitor. FormDino does not take custody of the payment proceeds.

The form owner is responsible for accurately describing what the payment is for; setting lawful prices; providing the product, service, registration, or other promised value; displaying any required policies and disclosures; handling customer service, taxes, receipts, refunds, disputes, and chargebacks; and complying with Stripe’s terms and applicable law. Form owners may not use visitor payments for prohibited or restricted activity.

Stripe processes card details and manages the connected account, payouts, and payment tools. Payment availability depends on the connected account remaining enabled and properly configured with Stripe. FormDino may disable payment features when an account is not ready or when reasonably necessary to protect the Service, its providers, form visitors, or other customers.

Third-party services

The Service may use or connect with third-party services for identity, payments, hosting, analytics, content delivery, communications, or other capabilities. Their terms and privacy practices govern your direct relationship with them. FormDino is not responsible for third-party services it does not control, and integrations may change or become unavailable.

FormDino property and feedback

FormDino and its licensors own the Service, software, designs, documentation, trademarks, and other materials we provide, excluding Customer Content. These Terms grant you a limited, revocable, non-transferable right to use the Service during your account term.

If you send ideas or feedback, you allow us to use them without restriction or compensation. You are not required to provide feedback.

Suspension and termination

You may stop using FormDino or cancel a subscription through available account controls. We may suspend or terminate access for nonpayment, violation of these Terms, legal or provider requirements, risk to the Service or others, or discontinuation of the Service.

When practical, we will provide notice and an opportunity to address the issue. Upon termination, your right to use the Service ends. Provisions that by their nature should survive—including payment obligations, ownership, disclaimers, liability limits, and dispute terms—will survive.

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” FormDino disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Service will always be uninterrupted, error-free, or suitable for every use, or that Customer Content will never be lost. Nothing in these Terms limits warranties or rights that cannot legally be limited.

Limits on liability

To the fullest extent permitted by law, FormDino and its affiliates, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity.

Our total liability arising from the Service or these Terms will not exceed the greater of $100 or the amount you paid FormDino during the 12 months before the event giving rise to the claim. These limits apply regardless of legal theory and even if a remedy fails of its essential purpose, but they do not apply where prohibited by law.

Indemnity

To the extent permitted by law, you will defend and indemnify FormDino from third-party claims, damages, and reasonable costs arising from your Customer Content, your forms or use of submissions, your violation of these Terms or law, or your infringement of another person’s rights. This does not apply to the extent a claim results from FormDino’s own unlawful conduct.

Governing law and disputes

Michigan law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, each party agrees to give the other written notice and 30 days to try to resolve the dispute informally.

Any legal proceeding must be brought in the state or federal courts serving Washtenaw County, Michigan, and each party consents to those courts. If applicable law gives you a non-waivable right to bring a claim elsewhere, that right controls.

Changes to these Terms

We may update these Terms as the Service, our business, or applicable law changes. We will post revised Terms with a new effective date and provide additional notice for material changes when required. Continued use after the effective date means you accept the revised Terms. If you do not agree, you must stop using the Service and cancel before the change takes effect.

General terms

These Terms, the Privacy Policy, purchase disclosures, and any signed agreement are the complete agreement for the Service. If a signed agreement conflicts with these Terms, the signed agreement controls for that subject. You may not assign these Terms without our consent; we may assign them in connection with our business or the Service. A failure to enforce a term is not a waiver. If one provision is unenforceable, the rest remain effective. Neither party is liable for delay caused by events beyond reasonable control.
